Article 1 – Purpose

These General Terms and Conditions of Sale (“GTCS”) govern the contractual relationship between Nova Performance LLC (hereinafter referred to as “the Seller”) and any person making a purchase on the website https://novalyx.co (hereinafter referred to as “the Customer”).

Article 2 – Products

The products offered for sale are those listed on the novalyx.co website on the day the Customer views the Site. Product photographs are provided for illustrative purposes only and are not contractual. In the event of an error, the Seller cannot be held liable. Products remain the property of the Seller until full payment has been received.

Article 3 – Prices

Product prices are indicated in United States dollars (USD) and are inclusive of all applicable taxes (if any, depending on the Customer’s location). Delivery charges are billed separately and will be displayed before the order is confirmed. The Seller reserves the right to modify its prices at any time; however, products will be billed based on the rates in effect at the time the order is confirmed.

Article 4 – Orders

The Customer places an order on the novalyx.co website. To be accepted, the order must be paid for in full. The Seller reserves the right to refuse or cancel any order for legitimate reasons, including suspicion of fraud, abnormal ordering patterns, or payment issues.

Article 5 – Payment

Payment is made by credit/debit card (and any other payment methods made available on the Site). The order will be considered effective only after confirmation of payment by the payment provider or banking institution.

Article 6 – Delivery

Products are delivered to the address provided by the Customer when placing the order. Estimated delivery times are approximately 14 days from order confirmation (unless otherwise stated on the product page).
In the event of a significant delivery delay, the Customer may request cancellation of the order and a refund, in accordance with applicable consumer protection laws.

Article 7 – Right of Withdrawal and Refund

Where applicable under consumer protection laws, the Customer has a 14-day withdrawal period from the date of receipt of the product to exercise their right of withdrawal without having to provide a reason or pay a penalty, for an exchange or refund.

To be eligible for a refund:

Products must be returned in their original packaging, unopened, and in perfect condition, within 7 days following the notification of withdrawal.
Return shipping costs are borne by the Customer, unless otherwise required by applicable law.
Before any return, the Customer must contact Customer Service and provide a return tracking number.

Refunds will be processed within 14 days from receipt of the returned products by the Seller (or from the time the Seller receives proof of return shipment, depending on applicable law). The refund will be made using the original payment method whenever possible.

Article 8 – Disputes

These GTCS are governed by the laws applicable to the Customer’s purchase and consumer rights, and, where permitted, by the laws of the State of New Mexico, United States. In the event of a dispute, the parties will seek an amicable solution prior to any legal action.
